1. About These Terms

These Terms & Conditions apply when you purchase products from Tides & Tribe through our website or, where applicable, arrange an order directly with us for local delivery or collection.

Please read these terms before placing an order.

By placing an order with us, you agree to these Terms & Conditions.

Nothing in these terms affects your statutory rights as a consumer.

2. About Tides & Tribe

Tides & Tribe is a family-run sea fishing brand and online retailer based in Whitstable, Kent.

Throughout these terms, references to "Tides & Tribe", "we", "us" and "our" mean DJ Jackson trading as Tides & Tribe.

3. Our Products

We make every reasonable effort to describe and display our products accurately.

Product photographs are provided to help illustrate the products we sell. Colours, packaging and appearance may vary slightly from photographs depending on your device, changes made by manufacturers or other reasonable variations.

Product packaging or branding may occasionally change without notice where the underlying product remains substantially the same.

Where dimensions, weights or measurements are provided, these should be treated as approximate unless we specifically state otherwise.

Nothing in these terms affects your legal rights regarding goods that are faulty, not as described or otherwise fail to meet the standards required by law.

4. Product Availability

All products are subject to availability.

We do our best to keep stock information accurate, but occasionally an item may become unavailable after an order has been placed.

If we cannot supply a product you've ordered, we'll contact you as soon as reasonably possible.

We may offer an alternative where appropriate, but you will never be required to accept a substitute. If we cannot fulfil an item you've paid for, we'll refund the amount due for that item.

5. Prices

Prices shown on our website are in pounds sterling (£).

The price payable is the price displayed when you place your order, subject to correction of genuine pricing errors as explained below.

Any applicable delivery charges will be shown or explained before you complete your purchase.

We may change our prices at any time, but changes will not normally affect orders that we've already accepted.

6. Pricing Errors

We take reasonable care to make sure our prices are correct.

Occasionally, however, an obvious pricing error may occur.

If we discover an error before accepting or fulfilling your order, we'll contact you and give you the opportunity to purchase the product at the correct price or cancel the affected item.

We won't knowingly take advantage of a pricing error, and we'll always try to resolve genuine mistakes fairly.

7. Placing an Online Order

When you place an order through our website, you're making an offer to purchase the products in your basket.

Payment is due at checkout.

After placing an order, you should receive an order acknowledgement or confirmation electronically.

An automated acknowledgement that we've received your order does not necessarily mean we've accepted it.

Our acceptance of your order, and the formation of the contract between us, takes place when we confirm acceptance or dispatch your order, whichever our checkout/order confirmation process expressly states.

If we're unable to accept your order, we'll let you know and refund any payment taken for goods we cannot supply.

8. Payment

Payment for website orders must be made at checkout using one of the payment methods offered on our website.

You must be authorised to use the payment method provided.

We won't normally dispatch an online order until payment has been successfully received or authorised.

For local delivery or collection orders arranged directly with us, we'll confirm the available payment arrangements when the order is placed.

9. UK Delivery

Our standard UK postal service is Royal Mail Tracked 48.

Our current standard delivery charges are:

**Orders over £60 – FREE UK delivery**

**Orders under £60 – £4.50 delivery**

We aim to dispatch postal orders on the same or next working day.

Royal Mail Tracked 48 is the postal service we normally use. Delivery times after dispatch are estimates rather than guaranteed arrival times unless we specifically agree otherwise.

10. Local Delivery – Whitstable & Herne Bay

We offer our own local delivery service within Whitstable and Herne Bay.

Our current local delivery charges are:

**Orders over £20 – FREE local delivery**

**Orders under £20 – £2.50 local delivery**

Local delivery orders must currently be arranged with us directly by telephone.

You can browse the products on our website and then call us to confirm your order, stock availability, payment and delivery arrangements.

Local delivery arrangements will be agreed with you when the order is placed.

11. Local Collection

We also offer **free local collection** by prior arrangement.

Collection orders must be arranged with us directly.

Please do not travel to collect an order until we've confirmed that your order is ready and agreed the collection arrangements with you.

12. Delivery Information

You are responsible for providing accurate delivery and contact information when ordering.

Please check your details carefully before completing an online order.

If you realise you've provided incorrect information, contact us as quickly as possible. We'll try to correct it before dispatch, but we cannot guarantee that changes will be possible once an order has entered the delivery process.

We'll deliver orders within the timescale agreed with you and in accordance with our legal obligations.

13. Risk and Ownership

Responsibility for goods will pass to you in accordance with applicable consumer law.

For orders delivered by a carrier selected by us, we remain responsible for the goods while they're being delivered to you as required by law.

Ownership of the goods passes to you once we've received payment in full and the applicable legal requirements for transfer have been satisfied.

14. Your Right to Cancel

If you're a consumer purchasing eligible goods online or through another qualifying distance sale, you will normally have a legal right to change your mind.

For most eligible goods, you have 14 days after receiving the goods to tell us that you wish to cancel.

You then normally have a further 14 days to return the goods.

There are exceptions to cancellation rights, including certain:

* perishable goods;

* products made to your specifications or clearly personalised; and

* sealed products that are not suitable for return for health protection or hygiene reasons once unsealed.

15. Faulty, Damaged or Incorrect Goods

We want customers to be confident buying from Tides & Tribe.

If a product is faulty, damaged, incorrectly supplied or not as described, please contact us as soon as possible.

Depending on the circumstances and your statutory rights, the appropriate remedy may include a refund, repair or replacement.

Nothing in these Terms & Conditions limits your statutory consumer rights.

16. Fishing Product Information & Responsible Use

Fishing involves natural environments, changing conditions and equipment that must be used appropriately.

Please read and follow any instructions, warnings and safety information supplied with products.

Customers are responsible for making sure products are suitable for their intended use and for using fishing equipment responsibly and in accordance with applicable laws, regulations and local restrictions.

Product information and fishing content provided by Tides & Tribe is intended to be helpful, but conditions, regulations, venues and individual circumstances can change.

Where appropriate, you should check current local rules and conditions before fishing.

Nothing in this section excludes or restricts liability where it would be unlawful for us to do so.

17. Our Liability

We are responsible for losses you suffer where the law says we're responsible for them.

We do not seek to exclude or restrict liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If you're purchasing as a consumer, we are not responsible for business losses arising from your purchase, such as loss of profit, revenue or business opportunity, where the products were purchased wholly or mainly for personal use.

Nothing in these terms is intended to remove any rights or remedies you have under applicable consumer law.

18. Events Outside Our Reasonable Control

Occasionally, circumstances outside our reasonable control may affect our ability to fulfil an order.

Examples could include severe weather, postal or courier disruption, transport problems, supplier disruption or other events we could not reasonably prevent.

If this happens, we'll do what we reasonably can to minimise the disruption and keep affected customers informed.

Your statutory rights remain unaffected.

19. Personal Information

We use personal information to process orders, take payment, arrange delivery, communicate with customers and operate Tides & Tribe.

Information about how we collect, use and protect personal data is provided in our Privacy Policy.

We may update these Terms & Conditions occasionally to reflect changes to our business, services or applicable law.

The terms applying to your purchase will normally be those in force when your order was placed.

We recommend checking this page periodically for updates.

21. Governing Law

These Terms & Conditions are governed by the laws applicable to your contract within the United Kingdom.

If you're a consumer, you retain any protections and rights regarding where legal proceedings may be brought that cannot lawfully be excluded or restricted by these terms.

We're a small family-run business and genuinely care about giving customers a good experience.

If something has gone wrong, please contact us and give us the opportunity to resolve it.
